Terms of Service

1. Acceptance of Terms

By accessing or using OakyScribe at oakyscribe.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

OakyScribe provides AI-powered audio and video transcription services, including:

• Automatic speech-to-text transcription
• Speaker identification and diarization
• AI-powered summarization and key point extraction
• Translation to multiple languages
• Multiple output formats (markdown, JSON, SRT subtitles)

3. Accounts

You may sign in using Google OAuth or email magic links. You are responsible for maintaining the security of your account. You must provide accurate information during registration.

4. Credits and Payments

• The Service operates on a credit-based system. Each transcription job consumes credits based on audio duration.
• New accounts receive free credits to try the Service.
• Additional credits can be purchased through Mercado Pago.
• Credits are non-refundable once purchased, except as required by applicable law.
• We reserve the right to modify pricing with reasonable notice.

5. Acceptable Use

You agree not to:

• Upload content that you do not have the right to process
• Use the Service for illegal purposes or to process illegal content
• Attempt to reverse-engineer, exploit, or compromise the Service
• Circumvent usage limits or authentication mechanisms
• Resell or redistribute the Service without authorization
• Submit content that contains malware or harmful code

6. Content Ownership

Your content remains yours. You retain all rights to the audio, video, and text content you upload or generate through the Service. We claim no ownership over your content.

We do not use your uploaded content to train AI models. Files are processed using pre-trained open-source models and are automatically deleted after processing.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We are not liable for any loss resulting from service interruptions.

8. Accuracy Disclaimer

Transcription, summarization, and translation are performed by AI models and may contain errors. Results should be reviewed before use in critical applications. We do not guarantee 100% accuracy and are not liable for errors in AI-generated output.

9. Limitation of Liability

To the maximum extent permitted by law, OakyScribe shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Chile. Any disputes shall be resolved in the courts of Santiago, Chile.
